  1. General Provisions

    1.1. This Privacy Policy (hereinafter – the “Policy”) sets out the procedure for the collection, processing, use, and protection of personal data of users of the website powerhouse.org.ua (hereinafter – the “Website”).

    1.2. The controller of personal data is Limited Liability Company “Powerhouse Group”, which operates under the trademark “Powerhouse” (hereinafter – the “Company”, “We/Us/Our”).

    1.3. The Company processes personal data in accordance with the Law of Ukraine “On Personal Data Protection” No. 2297-VI and other legal and regulatory acts of Ukraine in the field of personal data protection.

    1.4. By using the Website or providing Us with Your personal data through any feedback forms, You confirm that You have read this Policy and give Your consent to the processing of Your personal data under the terms defined in this document.

  2. Definitions

    2.1. In this Policy, the terms are used with the following meanings:

    • personal data – information or a set of information about a natural person who is identified or can be specifically identified;
    • processing of personal data – any action or set of actions performed on personal data, using automated means or without using such means (including, but not limited to: collection, registration, accumulation, storage, adaptation, alteration, renewal, use, dissemination, depersonalization, and destruction of personal data);
    • controller of personal data – the Company, which independently or jointly with other entities determines the purpose of personal data processing and establishes the composition of such data and the procedures for its processing;
    • data subject – a natural person in respect of whom personal data processing is carried out in accordance with the law;
    • consent of the data subject – the voluntary expression of will by a natural person to grant permission for the processing of his/her personal data in accordance with the stated purpose of such processing;

    2.2. Other terms are used in the meanings assigned to them by the legislation of Ukraine in force as of the date this Policy was last updated.

  3. Personal Data Collected by the Company

    3.1. Through feedback forms, request forms, and other interactive forms on the Website, the Company may collect:

    • last name, first name, and patronymic;
    • email address;
    • phone number;
    • organization name and job title;
    • content of the message or request;
    • other data that You voluntarily provide in the relevant form fields.

    Providing personal data through the Website’s forms is voluntary. Mandatory fields are marked accordingly. Failure to provide mandatory data may make it impossible to process Your request.

    3.2. When visiting the Website, the Company may collect and process anonymous technical data, including:

    • the IP address of the device used to access the Website;
    • browser type and version;
    • operating system type and version;
    • date, time, and duration of the visit to the Website;
    • URLs of the Website pages viewed;
    • the source of the transition to the Website (referral URL);

  4. Purpose and Legal Basis for Processing Personal Data

    4.1. The Company processes Your personal data solely to the extent necessary to achieve the following purposes:

    • responding to Your inquiries, requests, and messages sent through the Website’s forms;
    • establishing and maintaining business communication with the Company’s potential and existing clients;
    • providing information about the Company’s services at Your request;
    • ensuring the correct technical operation of the Website and resolving technical failures;
    • analyzing visitor statistics and user behavior in order to improve the quality and usability of the Website;
    • complying with the requirements of the legislation of Ukraine.

    4.2. The legal basis for the processing of personal data is Your consent (in accordance with Articles 6 and 11 of the Law of Ukraine “On Personal Data Protection”), which You provide when filling out forms and/or configuring the use of cookies on the Website.

  5. Transfer of Personal Data to Third Parties

    5.1. The Company does not transfer, exchange, or sell Your personal data to third parties without Your consent, except in cases provided for by this Policy or the legislation of Ukraine.

    5.2. Your personal data may be transferred to:

    • providers of technical services (hosting, analytics platforms, email services) that process data solely in accordance with Our instructions and within the framework of agreements concluded with them;
    • state authorities and officials in cases directly provided for by the legislation of Ukraine;
    • third parties in the event of the Company’s reorganization, merger, or acquisition – to the extent necessary for the continuation of business operations, and with notice to You of such fact.

    5.3. When transferring personal data to processors, the Company takes the necessary measures to ensure an adequate level of their protection.

  6. Protection of Personal Data

    6.1. The Company takes organizational, technical, and legal measures to protect personal data from unauthorized access, accidental loss, destruction, damage, or disclosure.

    Among the protective measures taken:

    • restricting access to personal data to only authorized persons who need such data to perform their official duties;
    • regularly reviewing and updating security measures in accordance with current requirements;
    • entering into agreements with personal data processors that contain confidentiality and security obligations.
  7. Data Retention Periods

    7.1. Personal data is stored for the period necessary to achieve the purposes for which it was collected, including:

    • data from feedback forms – for the period necessary to process the relevant request, and no more than 36 months after the end of that period;
    • technical data (IP addresses, visit logs) – for 36 months from the date of receipt;
    • data for which the legislation establishes special retention periods – in accordance with such periods.

    7.2. Upon expiration of the retention period, personal data is destroyed or depersonalized in a manner that makes its identification impossible.

  8. Rights of Data Subjects

    8.1. In accordance with the Law of Ukraine “On Personal Data Protection”, You have the following rights regarding Your personal data:

    • to know the sources of collection and location of Your personal data, the purpose of its processing, and the location or place of residence (stay) of the controller;
    • to receive information about the conditions under which access to personal data is granted, including information about third parties to whom Your personal data is transferred;
    • to access Your personal data;
    • to receive, no later than thirty calendar days from the date the request is received, a response as to whether Your personal data is being processed;
    • to submit a reasoned request objecting to the processing of Your personal data;
    • to submit a reasoned request for the modification or destruction of Your personal data if such data is processed unlawfully or is inaccurate;
    • to protection of Your personal data from unlawful processing and accidental loss, destruction, or damage caused by intentional concealment, failure to provide, or untimely provision thereof, as well as protection against the provision of information that is inaccurate or defames the honor, dignity, and business reputation of a natural person;
    • to file complaints regarding the processing of Your personal data with the Ukrainian Parliament Commissioner for Human Rights;
    • to apply legal remedies in the event of a violation of the legislation on personal data protection;
    • to withdraw Your consent to the processing of personal data.

    8.2. To exercise Your rights, You may contact Us in the manner specified in Section 12 of this Policy. We will review Your request within the timeframes established by the Law of Ukraine “On Personal Data Protection”.

    9.1. The Website may contain links to external websites and resources that are not under the Company’s control. This Policy applies exclusively to the Website powerhouse.org.ua. We are not responsible for the privacy of external resources and recommend reviewing their policies before providing any personal data.

  10. Changes to the Privacy Policy

    10.1. The Company reserves the right to make changes to this Policy at any time. The current version of the Policy is always posted on the Website, indicating the date of the last update.

    10.2. In the event of significant changes relating to the processing of Your personal data, the Company will notify You by posting a corresponding notice on the Website. Continued use of the Website after the changes take effect signifies Your consent to the updated Policy.
